Prior to December 1859, Queensland was part of New South Wales. So the Moreton Bay penal settlement was another region within the colony for convicts. Established as part of the 'plan of punishment' by Chief Justice Forbes who was carefully balancing the introduction of criminal legislation, crowded gaols, and the increasing influx of free settlers to New South Wales which at this time had been occupied for nearly 40 years.
